Government Relations Update - Canada - Bill 31

In response to Bill 31, AHP Canada worked closely with colleagues from across the Province and from the Association for Fundraising Professionals. Below are PDF copies of a letter to Minister Smitherman and the complete AHP Canada submission. Already amendments to Bill 31 are taking place and I am pleased to let you know that there is a draft amendment to section 31 which pertains to fund raising. As you know, the requirement in the draft Bill was for express consent. The proposed draft amendment follows. We should be very pleased with the opportunity for consideration of implied consent. We are in the process of finding out next steps and as they become clear will follow-up with further information on what this all means.

AHP Canada submission was strengthened by the input from practical examples demonstrating the negative impact of express consent. Thanks to everyone for your contributions to the submission.

I move that section 31 of the Personal Health Information Protection Act, 2003, be struck out and the following substituted:
Fundraising
31. (I) Subject to subsection (2), health information custodian may collect, use or disclose personal health information about an individual for the purpose of fundraising activities only where, (a) the individual expressly consents; or (b) the individual consents by way of an implied consent and the information consists only of the individual's name and the prescribed types of contact information.
